APPLICABILITY
1.The confirmation of contracts / orders to Termocelsius Lda imply the complete knowledge and acceptance from the Customer of these conditions unless others are agreed in writing by both parties.
PRODUCT CHARACTERISTICS AND CATALOGUES
2.The technical specifications, pictures and drawings presented in catalogues and quotations are indicative only and from the entirely responsibility of the brands and manufacturers.
TERMS OF DELIVERY
3.Terms of delivery and completion of the requested work have a merely guideline value, unless expressly agreed between parties a specific delivery date for completion of the work.
4. In case of goods not available in stock in our warehouse, the deadlines will always be communicated to Customer based on information supplied by the manufacturer.
5. In case of delayed delivery, based on the indicative delivery term from the manufacturer, does not justify the cancellation of the order by the Customer, or can be a motive to claim a compensation to Termocelsius Lda.
6. The same way Termocelsius Lda declines any responsibility for the delay in the delivery of goods, when this results in cases of force majeure or due to third parties.
PRICES
7. The prices presented in this proposal are valid to the mentioned work and quantities, not being able to be replicated for other situations.
8. The eventual price modification or the impossibility for the factories and/or suppliers to assure the price will be communicated by us before any supply or installation, being the responsibility of the client the decision to maintain or change the order of the equipment, decision that will happen in the deadline of 5 useful days after the reception of the communication.
9. These prices are subject to the application of the V.A.T tax in accordance with the current legal tax.
VALIDITY OF THE PROPOSAL
10.This proposal is valid for 30 days.
TERMS OF PAYMENT AND CREDIT
11.Invoices are to be paid upon delivery by check or bank transfer unless other conditions are agreed between parties.
12. Payment by instalments or credit are subject to the approval of the management of Termocelsius Lda, who may not be assigned any responsibility for the refusal.
13. In case of default by the Customer regarding payment deadlines agreed, Termocelsius Lda reserves the right to cancel deliveries, complaints, or orders in progress.
WARRANTY
14.The warranty of products supplied and installed by Termocelsius Lda, presented in this proposal are covered by the following points:
14.1. Termocelsius Lda ensures the warranty against manufacturing defects in agreement with the indication of the commercialized brands.
14.2. Our warranty consists of the repair and free replacement of defective parts recognized by Termocelsius, Lda being excluded other ways of warranty.
14.3. The replacement of defective parts will not extend the warranty period originally established; except when total replacement of equipment is renewed (warranty point 14.1.)
WARRANTY EXCLUSIONS
15.The warranty of products supplied and installed by Termocelsius Lda, can be excluded on the following points:
15.1. Malfunction or damage due to interventions caused by unauthorized personnel.
15.2. Defects caused by anomalies in electrical power, hydraulic or external factors.
15.3. Use of non-original replacement parts or unauthorized by Termocelsius Lda and/or manufacturer.
15.4. The reconfiguration of electronic equipment (Wifi, Routers and Cellphones) will be invoiced in the value of a technical assistance.
TECHNICAL ASSISTANCE
16. The requests for intervention under warranty must be requested at the services of Termocelsius, Lda.
16.1. Technical assistance and maintenance services are provided by authorized and accredited personnel of Termocelsius, Lda.
RESERVATION OF OWNERSHIP
17. Products are property of Termocelsius Lda until the complete payment and cashing of the entire sum due by the Customer, getting this faithful depository of the goods.
17.1. The ownership of the products supplied and installed by Termocelsius Lda, is transferred to the Customer when the value of the goods is paid in full (Artº 409 of the Civil Code).
HEALTH AND SAFETY AT WORK / INSURANCE
18. Termocelsius, Lda have contract of safety and hygiene at work with Centro-K, work injury insurance and civil liability insurance; this is a safeguard for our company and especially for our customers.
CERTIFICATION
19. Termocelsius Lda is a certified company by IAPMEI, has building permits No. 61509, CAE 43222 for installation of HVAC systems, certificate of competence for installation of solar systems nº 09/SOL/12833, technician of indoor air quality of buildings 1549-A/2009 and fulfills with all legal obligations in its activity.
COURT OF COMPETENT JURISDICTION
20. Termocelsius Lda and their clients submit to the exclusive competency/jurisdiction of the courts of Loulé.
DATA PROTECTION
The personal information gathered in the elaboration of this proposal might be used to send commercial information about Termocelsius’s services, except in the cases where the owner of the information is opposed to this sending of information and if there is any type of litigation, dispute, reclamation, or audit in which Termocelsius’s is brought to any regular or state entity.
We are devoted to complying with the confidentiality agreement relative to your personal information, as well as adopting the necessary measurements to avoid its modification, loss, treatment, or non-authorized access.
